3. Investment Risks
Cryptocurrency investments carry substantial risk and are not suitable for all investors. The value of cryptocurrencies can be extremely volatile and unpredictable. You may lose some or all of your invested capital. Past performance is not indicative of future results. HelixDigital Capital does not guarantee any specific returns or profits. You should carefully consider your investment objectives, level of experience, and risk appetite before making any investment decisions. You should not invest money that you cannot afford to lose.
4. Account Registration
To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.
5. User Responsibilities
You are solely responsible for your use of the platform and for any consequences thereof. You agree to use the platform only for lawful purposes and in accordance with these Terms. You agree not to: use the platform in any way that violates any applicable federal, state, local, or international law or regulation; engage in any conduct that restricts or inhibits anyone's use or enjoyment of the platform; impersonate or attempt to impersonate HelixDigital Capital, a HelixDigital Capital employee, another user, or any other person or entity; engage in any other conduct that we determine to be inappropriate or harmful.
6. Deposits and Withdrawals
All deposits and withdrawals are subject to verification and compliance procedures. We reserve the right to request additional documentation to verify your identity and the source of funds. Withdrawal requests may take up to 3-5 business days to process, depending on the payment method and verification requirements. Minimum deposit and withdrawal amounts may apply. We reserve the right to refuse or delay any deposit or withdrawal that we believe may be fraudulent, illegal, or in violation of these Terms. Transaction fees may apply to deposits and withdrawals.
7. Trading and Investment Plans
Investment plans offered on our platform are subject to specific terms and conditions, including minimum investment amounts, lock-in periods, and expected returns. Returns are estimates and not guaranteed. We reserve the right to modify, suspend, or discontinue any investment plan at any time without prior notice. Your participation in any investment plan constitutes acceptance of the specific terms and conditions associated with that plan. 8. Fees and Charges
HelixDigital Capital charges fees for certain services, including but not limited to trading fees, withdrawal fees, and management fees. All applicable fees will be clearly disclosed before you complete any transaction. We reserve the right to change our fee structure at any time, with or without notice. Continued use of the platform after fee changes constitutes acceptance of the new fee structure. All fees are non-refundable unless otherwise stated.
9. Privacy and Data Protection

By using our platform, you consent to the collection and use of your information as described in our Privacy Policy. You agree not to engage in any of the following prohibited activities: copying, distributing, or disclosing any part of the platform in any medium; using any automated system to access the platform; attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the platform; taking any action that imposes an unreasonable or disproportionately large load on our infrastructure; uploading invalid data, viruses, worms, or other software agents through the platform; collecting or harvesting any personally identifiable information from the platform; using the platform for any commercial solicitation purposes; impersonating another person or otherwise misrepresenting your affiliation with a person or entity; engaging in market manipulation, fraud, or any illegal activities.
12. Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis. HelixDigital Capital makes no representations or warranties of any kind, express or implied, as to the operation of the platform or the information, content, materials, or products included on the platform. You expressly agree that your use of the platform is at your sole risk. To the full extent permissible by applicable law, HelixDigital Capital disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
13. Limitation of Liability
In no event shall HelixDigital Capital, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: your access to or use of or inability to access or use the platform; any conduct or content of any third party on the platform; any content obtained from the platform; unauthorized access, use, or alteration of your transmissions or content; or any investment losses incurred through the use of our platform.
14. Indemnification
You agree to defend, indemnify, and hold harmless HelixDigital Capital and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: your use and access of the platform; your violation of any term of these Terms of Service; your violation of any third party right, including without limitation any copyright, property, or privacy right; or any claim that your use of the platform caused damage to a third party.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
16. Dispute Resolution
Any dispute arising out of or relating to these Terms or the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, HelixDigital Capital may seek injunctive or other equitable relief in any court of competent jurisdiction.
17. Account Termination
We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the platform and submit a termination request through our support channels. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
18. Anti-Money Laundering (AML) and Know Your Customer (KYC)
HelixDigital Capital is committed to preventing money laundering and terrorist financing. We comply with all applicable AML and KYC regulations. You agree to provide accurate identification documents and information when requested. We reserve the right to refuse service, freeze accounts, or report suspicious activities to relevant authorities. Failure to comply with our verification requirements may result in account suspension or termination.
19. Tax Obligations
You are solely responsible for determining what, if any, taxes apply to your cryptocurrency transactions and investments made through our platform. HelixDigital Capital is not responsible for determining the taxes that apply to your transactions. You are responsible for reporting and paying any taxes arising from your use of the platform. We may report information about your account and transactions to tax authorities as required by law.
20. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the platform.
